U.S. Supreme Court Finds Alabama’s Congressional Map Likely Violates Section 2 of the Voting Rights Act

In a 5-4 decision, the U.S. Supreme Court determined that Alabama’s redistricting map, adopted for the 2022 congressional elections, likely violated Section 2 of the Voting Rights Act. The Court also determined that, under its precedent set forth in Thornburg v. Gingles, the Alabama maps likely violated Section 2. The Court found that the plaintiffs satisfied the three preconditions of the Gingles test and carried their burden to prove that, based on the totality of the circumstances, the plaintiffs’ votes were diluted. The Court affirmed the judgments of the District Court for the Norther District of Alabama in the Caster case, and of the three judge panel in the Milligan case.
