The plaintiffs in the case are bringing suit against the Georgia State Election Board and members of the Fulton County Elections Board challenging Georgia's absentee ballot application deadline for presidential elections. They argue that under Section 202(d) of the VRA voters must be able to cast absentee ballots in Presidential elections if they applied seven days prior to the election. They state that Georgia SB 202 violates this provision because the latest it allows a voter to apply for an absentee ballot is eleven days before the election.
