Supreme Court Denies DOJ’s Application for Injunction Pending Appeal in California Case

In a brief order, Justice Kagan denied the Department of Justice’s application for an injunction pending appeal in United States v. California. In late October, a district judge denied the Department’s motion seeking an order for California to segregate and exclude over 20,000 ballots it claimed were connected to non-citizens on the voter rolls. Like the Supreme Court, the Ninth Circuit also denied the Department’s motion for injunction pending appeal.
